Strengths

A strong grasp of complex finance and legal issues; strong negotiation skills (including an ability to identify and account for political sensitivities); experience with the drafting of complex documentation; extensive dispute and advisory experience with firsthand knowledge of (and contacts in) the Middle East, CEE the former CIS; and proven expertise in the management of loc legal counsel across a number of jurisdictions in both a transactional and dispute related context.

Employment History

June 2018 – Present. Private practice trading under Petr Malecek LEGAL&MANAGEMENT SERVICES (formerly Peter Malecek KACELARIA PRAWNA) Petr Malecek’s areas of expertise include litigation management, dispute resolution, asset recovery (financed by 3rd party funders), cross border leverage finance (for acquisitions and various projects including infrastructure and utilities), sovereign finance (bond issues) and privatization. Also involved in the co-ordination of various advisors/practices, external contractors and third-party litigation funders in relation to dispute mandates across Europe. 

October 2016 – June 1, 2018 (Counsel) ADER HABER (formerly Spenser& Kauffmann), (Head of the Central European Desk). Role included advising the Deposit Guarantee Fund of Ukraine on the tracing and recovery of assets siphoned from the banking system through fraudulent transactions; also advised Ukrainian clients as well as foreign entities on a variety of dispute and transactional mandates including inter alia structured finance, the reconciliation of non - performing loans, securitizations and cross border financings (e.g. senior loan agreements governed by English law supported by “local” security in a number of jurisdictions), arbitration (including investment protection treaty disputes), M&A (including leveraged acquisition finance), debt restructuring and both trade and project finance. 

June 2012 – October 2016 Sole Private Practitioner Peter Malecek LEGAL&MANAGEMENT SERVICES (formerly Peter Malecek KACELARIA PRAWNA). Advising clients across CEE and MENA on financings, disputes (as well as providing dispute management services), corporate and commercial matters. Finance and dispute related mandates often required the supervision of counsel across several jurisdictions. Dispute and crime related mandates also involved the tracing and recovery of funds defrauded from investors. 

2007 – June 2012 (Lawyer - partner) CMS Cameron McKenna In 2007 was offered a partnership at CMS Cameron McKenna. Headed the firm’s banking practice in Warsaw and later Kyiv. The practice(s) advised foreign and local banks (including multinational entities such as the European Bank for Reconstruction and Development) as well as borrowers in respect of banking and finance matters. Transactions included project financings (in inter alia commercial real estate, residential real estate, agriculture, hotels/leisure and heavy industry), trade and asset finance. In many cases transactions involved taking security over real estate, moveable assets, securities, receivables and insurance policies across a number of jurisdictions.
In addition, responsible for the creation, development and management of a dedicated 'banking litigation practice' targeting the Ukrainian subsidiaries of international banks with a view to representing the banks in respect of litigation to enforce security and otherwise recover debts from delinquent corporate and other "high value" borrowers in Ukraine and across the region. Responsible for managing not only the personnel comprising the banking teams in Warsaw and Kyiv respectively but also lawyers across several jurisdictions as and when necessary to provide advice for both dispute and transactional matters. 

2005 – 2007 (Lawyer) Sole Private Practice Left White & Case in 2005 to open a sole private practice established for the purposes of advising on the establishment and financing of two telecommunications ventures in which he was a partner. 

2003 – 2005 (Lawyer) White&Case Responsible for the firm’s finance practice in Bratislava. Engaged in advising clients (both corporate and sovereign) in domestic and cross border financing and capital market transactions in both the Slovak Republic and the Czech Republic (mandates included advising the Slovak Ministry of Finance and ARDAL in relation to an MTN program that financed that country’s reforms).
